1. Scope

These Terms & Conditions ("Terms") apply to the use of the web app "TradeScope" ("App") and the usage contract between you and the operator. By registering and/or using the App, you accept these Terms in their current version.

2. Definitions

• Operator: The provider of the App named in the imprint.
• User: The natural person registering an account and using the App.
• App: The cloud-based Software-as-a-Service solution TradeScope under this website's domain.
• Content: All data entered by the User (trades, notes, screenshots, psychology logs, etc.).

3. Description and Scope of Services

TradeScope is a pure analysis and documentation tool for traders and provides:

• Trade logging, management and export (CSV/JSON)
• Broker import (CSV/XLSX) with automatic format detection
• AI-powered performance analysis and a conversational AI coach
• Risk Guard (real-time risk monitoring) and risk management
• Psychology tracking, playbook and backtest studio
• Data management (import/export) across multiple devices

The exact scope may change. Individual features may be time-limited, subject to restrictions, or (in future) paid.

4. Registration, Account and User Obligations

An account is required. You agree to:

• provide truthful and up-to-date information during registration;
• be at least 18 years old and have full legal capacity;
• keep access credentials confidential and not share them with third parties;
• notify the Operator immediately of unauthorized use or security incidents;
• not enter false, misleading or unlawful content.

You are responsible for all activity under your account.

6. Pricing, Fees and Payment Terms

Core features are currently provided free of charge. Any future paid features will be disclosed and separately agreed before purchase. No hidden costs arise from using the free features.

7. Usage Rights and Intellectual Property

You receive a simple, non-exclusive, non-transferable, limited right to use the App for your own personal purposes during the term of the usage contract.

All rights to the App (software, design, trademarks, content) remain with the Operator or its licensors.

8. Obligations and Prohibited Use

In particular, you may not:

• reverse engineer, decompile or disassemble the App;
• bypass usage restrictions or security mechanisms;
• access the App automatically (scraping, bots, crawlers);
• transmit viruses, malware or harmful code;
• use the App for illegal, misleading or anti-competitive purposes;
• enter content that infringes third-party rights or applicable law.

9. User Content

You remain the owner of all content you enter. You grant the Operator a limited right to process your content solely for providing the App functions (storage, analysis, display, AI processing). You indemnify the Operator against third-party claims based on your unlawful content.

10. Availability and Maintenance

The Operator strives for high availability but does not guarantee any specific uptime. Maintenance, updates and incidents may cause temporary interruptions. The App is provided "as is".

11. Warranty

The App is provided subject to technical availability. The Operator gives no warranty for error-free, uninterrupted or secure use, nor that the App fully meets your requirements or that analyses or AI statements are correct or complete.

12. Limitation of Liability

The Operator's liability is unlimited only for intent and gross negligence and under mandatory German liability law (in particular the Product Liability Act and for damages arising from injury to life, body or health). For slight negligence, the Operator is liable only for breach of an essential contractual obligation and only up to the amount of typical, foreseeable damages.

The Operator is not liable for trading losses, lost profits or financial damages arising in connection with the use of the App, its analyses or AI recommendations.

13. Data Protection

The processing of personal data is governed by the separate Privacy Policy, which is referenced here.

14. Term, Termination and Account Deletion

The usage contract runs indefinitely. You can delete your account at any time (Profile → Account), which ends the contract. Upon termination, all your data is deleted within 30 days; exporting your data beforehand is recommended.

The Operator may suspend accounts early in case of serious violations of these Terms or applicable law.

15. Changes to Terms and Services

The Operator may update these Terms with reasonable prior notice (usually 30 days). You will be informed of material changes in the App or by email. Continued use after the change date constitutes acceptance; otherwise you may terminate the contract.

16. Right of Withdrawal and Risk Disclosure

Consumers have a statutory right of withdrawal, see Right of Withdrawal. The Risk Disclosure forms part of these Terms and is expressly confirmed at registration.

17. Final Provisions

• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• Place of jurisdiction is the Operator's registered office if the User is an entrepreneur; for consumers the statutory place of jurisdiction applies.
• Should any provision be invalid or unenforceable, the remaining provisions remain unaffected (§ 306 BGB).
• Contract language is German.
